The website, www.ilikebooks.co.za sells eBooks, and by reading and agreeing to these terms and conditions, the customer acknowledges this fact, and confirms that he/she intends to buy a digital product, and not a physical product.
The Visitor must ensure that they comply with the provisions of these Terms and Conditions.
This website (www.ilikebooks.co.za) is an on-line e-store. By entering the I Like Books website or using the services of the Service Provider the customer/account holder agrees to comply with all of the terms and conditions contained herein. The right to use the Service Provider is not transferable to any other person or entity. The customer/account holder is solely responsible for all account activities, subscriptions and or any other interactions through the I Like Books website which is accessible only through the customer/account holder’s own unique password.
In terms of the Service Provider’s policy the order of digital products via I Like Books constitutes a firm sale of an eBook and once an eBook has been downloaded and an order confirmation has been sent to the customer/account holder in the prescribed manner, the order is final and cannot be cancelled or returned. Note that by purchasing an eBook the customer/account holder only acquires the right to download such eBook.
The customer/account holder’s information, profile and password shall at all times be treated as confidential by the Service Provider. The customer/account holder shall at all times remain responsible for protecting the confidentiality of their password(s).
4. Published Information/Content
All content and information about publications/books and other products and services offered by the Service Provider, including, but not limited to, publication schedules, features and content, and appropriateness for particular audiences is provided to the Service Provider by the publishers of those titles and is the sole responsibility of those publishers. The Service Provider assumes no responsibility for published content or the accuracy of information provided to it by the publishers.
5. Changes to service offering by the Service Provider
The Service Provider shall have the right at any time and without notice to change or discontinue any aspect or feature of the Service Provider’s website, including, but not limited to, content, hours of availability, and equipment required for access or use.
6. Consent to receiving of electronic communications
Through the use of this website or communicating with the Service Provider by e-mail, the customer/account holder consents and acknowledges that any and all agreements, notices, disclosures, or any other communication complies with all legal requirement(s), including but not limited to the requirement that such communications so delivered, should be in writing.
7. Credit card acquiring – Payment gateway
Credit Card Transactions are acquired by PayFast, a registered systems operator and payment gateway in South Africa. Card Holders may go to www.payfast.co.za to view PayFast’s security policy. The Visitor’s credit card details will, in accordance with legislation, be kept secure and not be accessible by any unauthorized individual. PayFast currently uses Extended Validation SSL with 256-bit encryption, which is the highest level of encryption currently available.
8. Copyright and other Intellectual Property Rights
The Service Provider provides certain information on the Website that might be protected by copyright legislation. Content currently or anticipated to be displayed on this Website is provided by the Service Provider, its affiliates and/or subsidiary, or any other third party owners of such content.
All eBooks are the exclusive property of the publisher or its licencors and are protected by copyright and other intellectual property laws. All such proprietary works, and the compilation of the proprietary works, are copyright protected Content of the Publishers, the Service Provider, its affiliates or subsidiary, or any other third party owner of such rights (“the Owners”), and are protected by South African and international copyright laws. All rights in and to the content are reserved and retained by the Owners of the specific information/Content. The customer/account holder is not granted a license or any other right including without limitation to Copyright, Trademark, Patent or any other Intellectual Property Rights in or to the Content.
Digital Rights Management and illegal use
Where content is DRM-protected, the Visitor who first clicks on the eBook URL which downloads the eBook will be able to read the eBook on up to six (or less if specified by the publisher) devices that are associated with the customer/account holder’s Adobe profile. The download of eBooks is intended for personal and non-commercial use only. Note that DRM (digital rights management) applies to certain content and that if a file has been DRM-protected any other use of eBooks purchased from the Service Provider is illegal and strictly prohibited, including but not limited to modify, transmit, publish, participate in the transfer or sale of, reproduce, create derivative works from, distribute, perform, display, or in any way exploit, any of the content of eBooks, in whole or in part.
9. Limitation of liability
The Website and all Content on the Website, including but not limited to any current or future offer of products or services, are provided on an “as is” basis, and may include inaccuracies or typographical errors. The Service Provider makes no warranty or representation as to the availability, accuracy or completeness of the Content. Neither the Service Provider nor any holding company, affiliate or subsidiary of the Service Provider, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if the Service Provider is expressly advised thereof.
The purchase or use of any products or services from this Website is at the customer/account holder’s risk. The customer/account holder indemnifies and holds the Service Provider harmless against any loss, injury or damages which may be sustained as a result of purchasing or using the products sold on this Website.
11. Updating of these Terms and Conditions
The Service Provider reserves the rights to change, modify, add or remove portions or the whole of these Terms and Conditions from time to time without prior notification. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the customer/account holder’s responsibility to periodically check these Terms and Conditions on the Website for changes or updates. The customer/account holder’s continued use of this Website following the posting of changes or updates will be considered adequate notice of the customer/account holder’s acceptance to abide by and be bound by these amended Terms and Conditions, including such changes or updates.
This Website is controlled, operated and administered by the Service Provider from its offices within the Republic of South Africa. Access to the Website from territories or countries where the Content or purchase of the products sold on the Website is illegal, is prohibited. The customer/account holder may not use this Website in violation of South African export laws and regulations. If the customer/account holder accesses this Website from locations outside of South Africa that customer/account holder shall at all time remain responsible for compliance with all such local laws.
Note that some titles have territorial restrictions applied to them and may therefore not be available in all countries.
13. Whole agreement
These Terms and Conditions constitute the entire agreement between the Service Provider and the customer/account holder with regard to the use of the Content and services conducted through/on this Website.
“DRM” means security measures for digital editions of titles. DRM is any technical security measure that restricts what third parties can do with an electronic file.
“EBooks” means electronic books, also known as digital books. eBooks are the digital equivalent of traditional printed books, consumable on e-readers, PCs, Macs and other mobile devices.
“Content” includes copyright protectable content, including but is not limited to Literary Works, Musical Works, Artistic Works, Sound Recordings, Cinematograph Films, Sound and Television Broadcasts, Program-Carrying Signals, Published Editions and Computer Programs.
“Publisher” means the owner of proprietary content
“Sale” means the successful order, download and receipt of an e-Book by a customer. When a technical malfunction requires multiple deliveries to a single customer to successfully fulfil the order, such multiple deliveries will be accounted for as a single sale of the Title.
“Service Provider” means Nobel Books via Ilikebooks.co.za
“Customer/Account holder” means any person entering or using the website or services of the Service Provider
